1.3 Applicability

These Terms and Conditions apply to all purchases made on the website www.ernesto-alaimo.com by consumers pursuant to the Consumer Code (Legislative Decree 206/2005).

2. CONCLUSION OF THE CONTRACT

2.2 Contract Confirmation

The automatic receipt of the order confirmation via email is merely an acknowledgement of the request and does not constitute definitive acceptance thereof. The sales contract is considered concluded only at the moment the shipping confirmation for the goods is sent.

The Seller reserves the right to evaluate the acceptance of the order and the feasibility of specific payment methods (including cash on delivery) at its own discretion, and may refuse or cancel an order before shipping, by way of example and not limitation, in the following cases:

  • Sudden or subsequent unavailability of products in stock;

  • Failure to authorize payment or suspicion of fraudulent transactions;

  • Material and gross errors in the indication of prices or product descriptions;

  • Shipments destined for Minor Islands or Disadvantaged Areas for which cash on delivery was selected.

In the event of an order cancellation before shipment, any amount already paid by the customer will be fully and promptly refunded.

2.3 Language of the Contract

The contract is drawn up in Italian. All communications will be in Italian.

2.4 Right to Refuse and Cancel Orders

The Seller reserves the right to refuse or cancel an order at any time before processing in the event of: unreliability of customer history (failure to collect previous cash-on-delivery orders or unresolved shipments held in storage), unpaid debts, or anomalies found in contact/shipping details. Any amount already paid will be fully refunded.

  • Previous delivery attempts that failed or shipments held in storage due to the recipient's absence/refusal;

  • Failure to collect shipments resulting in storage costs or return to sender.

In such cases, the order will be suspended or cancelled, and the customer will be requested to provide confirmation after selecting an advance payment method.

    Visual representations are for indicative purposes. The actual compliance and characteristics of the purchased product are determined by the descriptions and technical specifications present in the product sheet (indicated materials, dimensions, lens type) and any actual photographs of the individual product (still life), where available.

    For any dispute, the Court of Agrigento shall have exclusive jurisdiction.
